Terms of Use.

These terms are an agreement between you and Elevara (“Elevara,” “we,” “us”), run by Jordan, the owner, in Southwest Florida. They cover your use of:

• this website, elevara.agency, and everything on it;
• our phone line, (239) 251-5474, including Miles, our AI assistant.

By using the website or calling the line, you agree to these terms. Our Privacy Policy explains how we handle personal information. If you don’t agree, please don’t use the website or the phone line.

If you use them for a business, you agree to these terms for that business too, and confirm you can.

• If you sign up for a plan on this site, our Terms of Service and Data Processing Addendum cover it.
• Other work we do for you, such as an audit or a custom build, is governed by a separate written services agreement signed by Jordan.
• If either of those conflicts with these terms, it wins for that work.

• The website and phone line are meant for businesses and adults, not children.
• Give accurate information when you fill in a form or book a call.
• Only share someone else’s information when you have the right to.
• We can change, suspend or stop any part of the website or phone line at any time, without notice.
• We can limit or block access for anyone who breaks these terms.

• Miles, who answers our phone line, is an AI assistant, not a person. He’ll tell you so if you ask.
• Miles can make mistakes. He may misunderstand you, mishear a name or a number, or give information that is incomplete, out of date or wrong. Confirm anything important with Jordan in writing.
• Nothing Miles says is a binding offer, quote, promise or agreement. Only our Terms of Service for a plan you buy, or a written agreement signed by Jordan, binds Elevara.
• Calls are recorded, transcribed and summarized. Our Privacy Policy explains how.

• Apart from plans you buy through our checkout, nothing on this website, including the cost calculator, examples and demos, is an offer to sell or a quote. It’s general information.
• A price is final only when you agree to it at checkout, or when it’s in a written agreement signed by Jordan.
• Our Disclaimer explains what the results, estimates and examples on this site mean.

• The website and everything on it, including its text, design, graphics, animations, code, and the Elevara name and logo, belong to Elevara or to the people who license them to us. Intellectual property laws protect them.
• You may view the site and share links to it. You may not copy, republish, sell or make derivative works from it without our written permission.
• Other companies’ names and logos on the site belong to their owners.
• If you send us ideas or feedback, we may use them without owing you anything.

When you use the website or the phone line, don’t:

• break the law, or use them to harm anyone;
• try to get into systems or data you aren’t allowed to access, or probe, scan or test our security;
• interfere with the website, our forms or the phone line, including by overloading them;
• use bots, scrapers or other automated means to access the site, submit forms or call the line, except search engines indexing public pages;
• submit false information or spam, or pretend to be someone else;
• try to trick or misuse Miles, for example to make him reveal how he works or anything about other callers, or to say things he shouldn’t;
• send viruses or other harmful code;
• harass or abuse anyone, including Jordan or Miles.

If you break these rules, we can block you and take any other action the law allows.

• The site links to, and our work uses, services run by other companies, such as scheduling, payments and e-signatures. We don’t control them and aren’t responsible for their content, availability or practices. Their own terms and privacy policies apply.
• A link to another site isn’t an endorsement of it.

The website and the phone line are provided “as is” and “as available.”

To the fullest extent the law allows, Elevara disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy.

We don’t promise that the website or the phone line will be available, uninterrupted, error-free, secure or free of viruses, or that information on them, including anything Miles says, is accurate, complete or current.

Some places don’t allow some of these disclaimers, so some may not apply to you.

To the fullest extent the law allows:

• Elevara, its owner and anyone working on its behalf won’t be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, savings, data or goodwill, arising from or related to the website, the phone line or these terms, even if we were told they were possible.
• Our total liability for all claims about the website, the phone line or these terms is limited to $100.

These limits apply whatever the legal theory, whether contract, tort (including negligence) or anything else. Some places don’t allow some of these limits, so some may not apply to you. They don’t limit any liability the law doesn’t allow to be limited.

This section doesn’t change our Terms of Service for plans or a signed services agreement, which have their own terms.

You agree to defend, indemnify and hold harmless Elevara, its owner and anyone working on its behalf from any claims, losses, damages, liabilities, costs and expenses, including reasonable attorneys’ fees, that arise from:

• your use or misuse of the website or the phone line;
• your breaking these terms;
• your breaking any law or anyone else’s rights, including by giving us information you didn’t have the right to share.

• The laws of the State of Florida, and applicable federal law, govern these terms, without regard to conflict-of-laws rules.
• Any dispute about the website, the phone line or these terms must be brought only in the state or federal courts located in Florida. You and Elevara agree to the jurisdiction of those courts and to venue there.

• If any part of these terms can’t be enforced, the rest still applies.
• If we don’t enforce a term right away, we haven’t given up the right to enforce it.
• You can’t transfer your rights under these terms. We may transfer ours, for example to a company that takes over Elevara’s business.
• These terms, the Privacy Policy and the Disclaimer are the whole agreement between you and Elevara about the website and the phone line. Our Terms of Service for plans and a signed services agreement each cover their own subject.
• The sections on our content, warranties, liability, indemnity, Florida law and these general terms keep applying after you stop using the website or the phone line.

We may update these terms. The new version applies from the effective date posted at the top of this page. If you keep using the website or the phone line after that, you accept the new terms.
